IMO treaty to prevent the spread of harmful aquatic organisms and pathogens through ships’ ballast water came into force globally in September 2017
The International Convention for the Control and Management of Ships’ Ballast Water and Sediments (BWM Convention) was adopted by the IMO in 2004 to help prevent the spread of invasive or harmful aquatic species from one region to another. The Convention sets out detailed standards and procedures to manage and control the discharge of ballast water and sediments by merchant vessels into the waters of member states.
Executive decree
Brazil’s National Congress approved the BWM Convention, through Legislative Decree 148 of 12 March 2010, and it entered into force from 8 September 2017.
Following the legislative process, President Bolsonaro issued Executive Decree 10,980 of 25 February 2022, promulgating the Convention. The act came to effect upon its publication in today’s Official Gazette.
Maritime authority regulation
The BWM Convention is regulated by the Navy’s Directorate of Ports and Coasts (DPC) through the Maritime Authority Standard for the Management of Ship’s Ballast Water, known as NORMAM/20/DPC, which was last revised in 2021.
