Last Thursday (23 May), the Agência Nacional do Petróleo, Gás Natural e Biocombustíveis – ANP (National Agency of Petroleum, Natural Gas and Biofuels) published Resolution 789/2019 to amend Technical Note 5/2010 annexed to ANP Resolution 52/2010, which regulates the specifications of marine fuel oils for vessels without an exhaust gas cleaning system (scrubbers).
The amendment incorporates the limit of 0.5% mass by mass of sulphur oxides (SOx) content limit in marine fuel oils as set out in Annex VI of the IMO International Convention for the Prevention of Pollution from Ships (MARPOL) seeking to limit airborne emissions from vessels to improve air quality and protect the environment. Under the domestic regulation, vessels fitted with scrubbers may still use fuel oil with a sulphur content not exceeding 3.5% m/m.
Resolution 789/2019 will come into effect as of 1st January 2020, when the IMO sulphur content cap will apply worldwide. The document, in Portuguese, can be downloaded here.
To ensure compliance with MARPOL convention and the provisions of the national regulation, vessels trading in Brazil must carry a valid International Air Pollution Prevention Certificate (IAPP) and, when taking on fuel oil, must obtain a bunker delivery note clearly stating the sulphur content of the fuel oil supplied, and retain samples for later verification, if necessary.
Failure to comply with the regulations may subject the offenders to civil, administrative and criminal penalties.
