A practical guide to navigating Brazil’s complex foreign trade landscape, covering cargo clearance and delivery and explaining the new dual VAT reform and Siscomex regulatory compliance

The complexities of the Brazilian foreign trade framework present a continuous challenge for overseas ship operators, charterers, and insurers. Navigating an intricate web of domestic laws, an elaborate tax structure, and numerous intervening authorities requires both meticulous attention and specialised knowledge. To address these challenges, our guide “Cargo Clearance and Delivery in Brazil – Practical Guidance”, originally issued in 2017 and updated to the current legislation, provides a concise resource to clarify the nuances of the country’s regulatory landscape.

Brazil is currently undergoing a significant transition toward full digitalisation, centred on the Siscomex single-window system. This platform streamlines the registration, monitoring, and clearance of imports and exports by integrating over twenty agencies into a paperless environment. A profound change highlighted in the guide is the implementation of a new dual value-added tax (VAT) system, consisting of the federal CBS tax and the subnational IBS tax. The tax reform aims to replace a fragmented, cascading model with a transparent structure, fundamentally reshaping how goods are taxed while aiming to reduce litigation.

The publication underscores that established customs clearance and physical cargo delivery procedures remain largely unchanged. Customs-bonded facilities are still required to demand the original (or digitised) bills of lading and explicit authorisation before goods are surrendered. Furthermore, stringent cargo manifest reporting requirements persist, making timely data entry into the Siscarga and Mercante modules paramount to avoiding significant automated fines.
